15，有关滞期费和速遣费
15.3 On sailing of the vessel and at submission of the load port Lay Time statement by the Buyers, the Seller has to confirm these calculation within 21 (twenty one) working days from the submission date of time sheet and Statement of Fact (SOF). Further any demurrage / dispatch amounts incurred at the load port are to be settled latest within 30 (thirty) days from the date of submission of the Lay time statement.

15.4 Shipping Tolerance
The master of the vessel shall be entitled to increase or decrease the quantity of the Coal to be loaded on to a vessel within the range of +/-10% (such range shall be in hereinafter called “Shipping Tolerance”). However, the quantity of the Coal to be loaded onto a vessel shall mean the tonnage notified by the Buyer to the Seller and confirmed in accordance with the provisions of Article 14.

15.5 The Seller shall discuss closely with master of loading procedures for the loading at the loading port.

16.1 Both of the Buyer and the Seller shall adopt 100% Irrevocable, Non-transferable, Confirmed, Letter of Credit at sight opened by SWIFT only (FULL AMOUNT/ 100% OF INVOICE VALUE), The Letter of Credit shall be issued by HSBC, Standard Chartered or Top 100 World Banks.. 18.1 The Seller shall load the Coal at Taboneo or Tanjung Pemancingan Anchorage port, South Kalimantan, Indonesia.

18.2 The Seller should settle the full and legal export procedures; otherwise all the losses shall be the Seller’s account. All the expenses at loading port (include the expenses of analysis report, export tariff and all other expenses in Indonesia) is for the Seller’s account. All the expenses at discharging port are for the Buyer’s account.

18.3 Within forty-eight (48) hours after the vessel departure from the port of loading, the Seller’s shipping agent shall advise the Buyer by way of telex/cable/fax (Fax:) indicating the vessel sailing date, the name of the nominated vessel, name of shipping company, tonnage, the flags of the vessel, ocean bill of lading number, Contract number, net quantity loaded, name of commodity and estimated time of arrival (ETA).

21.2 The time of the Seller to make or the Buyer to receive delivery hereunder shall be extended during any period in which delivery shall be delayed or presented for more than 60 (sixty) days, either party may terminate this Contract in which case neither party shall have the right for claim eventual damages. In order for prevision of this cause to become operative, the party of the Contract affected by the force majeure conditions must furnish the other party with written notice about the nature and extent of the conditions promptly after the commencement thereof. The written notice shall also be furnished to the party when the condition cases to exist.
